Minnesota has both insurance fairness and So Every BODY Can Move Legislation
Legislative Activity
In 2024, Minnesota Governor Tim Walz signed So Every BODY Can Move legislation into law. SF-3351/HF-3339 requires coverage for prosthetic and orthotic devices that meet the medical needs of the enrollee for purposes of performing physical activities, as applicable, including but not limited to running, biking, and swimming, and maximizing the enrollee’s limb function, or for showering or bathing.
This legislation also contained an insurance fairness provision.
The legislation stipulates that a health plan company shall not deny a prosthetic or orthotic benefit for an individual with limb loss or absence that would otherwise be covered for a nondisabled person seeking medical or surgical intervention to restore or maintain the ability to perform the same physical activity. The legislation covers state commercial plans and Medicaid. The effective date of this legislation is January 1st, 2025.
The Minnesota State Legislature has previously introduced Insurance Fairness for Amputees. The most recent introduction took place during the 88th (2013-2014) Legislative Session, which saw legislation introduced in both chambers. HF675 was introduced and referred to House Health and Human Services Committee and SF1075 was referred to the Senate Commerce Committee. Neither bill received any consideration before the committee of reference.
State Government Information
The Democratic Party controls the House of Representatives and the Republican Party controls the Senate. The Democratic Farmer-Labor Party controls the Office of the Governor.
Minnesota’s State Legislature works on a two year cycle. Session runs from January until May in the first year and February until March in the second.
The Office of Governor has an election every four years that coincides with Congressional Mid-Term Elections. The next election will be held in 2022. An individual elected to the Office of the Governor is not limited to the number of terms they can serve. The Governor is responsible for signing legislation into law and granting formal proclamations, such as Limb Loss Awareness Month.
The Minnesota Division of Insurance is housed in the Department of Commerce. The Governor appoints the Commissioner of Insurance to observe the oversight of the insurance industry. The Division provides information about insurance payment reforms and the ability to file a complaint against an insurance provider.
